Standard Terms for Rural Tourism Services 2024 for Consumers<\/p>\n

 <\/p>\n

    \n
  1. Scope of application<\/li>\n<\/ol>\n

    These standard terms apply to an agreement concerning a rural tourism service when the Rural Tourism Entrepreneur provides rural tourism services to a private Customer or to a group of two or more Customers. This agreement does not apply in situations where travel packages are offered. <\/p>\n

      \n
    1. Definition<\/li>\n<\/ol>\n

      Rural tourism service in these standard terms means:<\/p>\n

        \n
      1. a) accommodation;<\/li>\n
      2. b) accommodation and another such tourism service that is not essential to the overall package;<\/li>\n
      3. c) one or more programme services such as, for example; meals, banquet, celebration and meeting arrangements, the organisation of leisure and recreational activities, such as fishing, skiing, hiking, horse riding, canoeing and forest excursions, as well as instruction, guidance and training related to the services, taking section b) into account; or <\/li>\n
      4. d) transport as part of the service package.<\/li>\n<\/ol>\n

        In these terms, Rural Tourism Entrepreneur means a company that offers rural tourism services to consumers through a separate offer, application (for example social media or website) or by other means.<\/p>\n

        In these terms, Customer means a consumer customer.<\/p>\n

          \n
        1. Applicable laws<\/li>\n<\/ol>\n

          The Consumer Protection Act, the Contracts Act and other legislation apply to the agreement concerning the rural tourism service.<\/p>\n

          The Package Travel Act applies only in situations where its application is mandatory by law.<\/p>\n

            \n
          1. Formation of the agreement<\/li>\n<\/ol>\n

            The agreement is formed when Maatilamatkailu Kivennapa has made an offer and the Customer has accepted it unchanged.<\/p>\n

            These terms become binding on the parties and part of the agreement when the terms have been sent to the Customer or the Customer has been sent a link to the terms and they have been referred to in the offer before the agreement is formed or when the agreement is formed. The terms or link to the terms are always deemed to have been delivered if they have been sent to the address, email address, phone number or other means of communication provided or used by the Customer. <\/p>\n

            The agreement is also formed when the Customer has submitted an order to Maatilamatkailu Kivennapa directly or via an application based on its price list or offer, and Maatilamatkailu Kivennapa confirms the order, or the confirmation is made by the application. In this case as well, these terms become binding on the parties when the terms have been available to the Customer and have been referred to. <\/p>\n

            The Customer must identify themselves in accordance with separately provided instructions through the application or otherwise when booking Maatilamatkailu Kivennapa\u2019s services. Maatilamatkailu Kivennapa complies with at least the data protection required by law. <\/p>\n

              \n
            1. Payment terms<\/li>\n<\/ol>\n

              The payment terms in this section apply unless Maatilamatkailu Kivennapa and the Customer have agreed otherwise.<\/p>\n

              At the time of booking the service, 50% (including any value added tax) of the service price is paid, and the remaining 50% (including any value added tax) of the total service price is paid 14 days before the agreed start date of the booking. If the booking is made less than 30 days before the service begins, the Customer pays the full price of the service at the time of booking. Payments are not refunded, nor is collection of them waived, unless otherwise stated in the sections below. <\/p>\n

              If the booking is made by phone, the booking is confirmed to the Customer by electronic means and these terms and conditions are provided at the same time, setting out how the Customer has the right to cancel the booking they have made.<\/p>\n

              If the Customer does not pay the invoice they have received by the due date, statutory late payment interest will be charged on the overdue amount, as well as collection costs.<\/p>\n

                \n
              1. Customer\u2019s right to cancel the booking<\/li>\n<\/ol>\n

                If the provisions of the Consumer Protection Act concerning distance selling apply to the Customer\u2019s order, the Customer has 14 days to cancel the order.<\/p>\n

                The Customer must check whether their travel insurance provides compensation for any costs arising from a possible cancellation.<\/p>\n

                If the cancellation is due to an absolute travel ban imposed by an authority, the Customer has the right to cancel. In the case of a pandemic or similar situation, this does not in itself entitle the Customer to cancellation if it does not directly prevent the provision and use of the service, or if information about the pandemic was available before the booking. <\/p>\n

                The obstacle must be reported without delay to Maatilamatkailu Kivennapa by email, text message or another reliable method. Illness, accident or another event preventing the use of the service does not entitle the Customer to cancel the service, and the Customer may seek compensation, for example, from their own insurance company. <\/p>\n

                Unless the Customer and Maatilamatkailu Kivennapa have agreed otherwise or Maatilamatkailu Kivennapa has stated otherwise, the Customer\u2019s right to cancel the booking without a reason agreed in advance is possible as follows:<\/p>\n

                  \n
                1. a) no later than three months before the start of the service by paying the costs of Maatilamatkailu Kivennapa notified in advance, however at least 25% of the total price of the service;<\/li>\n
                2. b) later than 3 months, but no later than 30 days before the start of the service, by paying 35% of the total price of the service;<\/li>\n
                3. c) later than one month, but no later than 14 days before the start of the service, by paying 50% of the total price of the service; and<\/li>\n
                4. d) later than 14 days before the start of the service, by paying 100% of the total price of the service.<\/li>\n<\/ol>\n

                  The Customer must always notify Maatilamatkailu Kivennapa if they will not use the service or will use substantially less than agreed, for example if the number of persons or duration changes from what was agreed. Reducing services is possible in the situations and schedules set out above, reducing the price paid by the Customer accordingly. Otherwise, and regardless of the use of the services, the Customer is obliged to pay the agreed total price, unless the Customer and Maatilamatkailu Kivennapa agree otherwise. <\/p>\n

                  Notice of cancellation or reduction of the service must be made in writing or electronically, or if the notice cannot be made in writing\/electronically, by another reliable method to the address, contact details or contact information provided by Maatilamatkailu Kivennapa.<\/p>\n

                  If the Customer does not use all agreed services or uses them only in part (for example, reductions in the number of persons), they are not entitled on this basis to a price reduction or refund, unless the services have been cancelled in accordance with the terms of this agreement or Maatilamatkailu Kivennapa and the Customer have separately agreed otherwise.<\/p>\n

                    \n
                  1. Maatilamatkailu Kivennapa\u2019s right to terminate the agreement<\/li>\n<\/ol>\n

                    Maatilamatkailu Kivennapa has the right to terminate the agreement or suspend the performance of the service if force majeure, such as fire, power outage, natural disaster, action by authorities, strike or another comparable unforeseeable event beyond the control of Maatilamatkailu Kivennapa, prevents or substantially hinders the provision of the service. If the agreement is terminated, the Customer must be refunded the full price paid, or if the performance of the service is suspended, the price corresponding to the unperformed part within a reasonable time. <\/p>\n

                    Maatilamatkailu Kivennapa must notify the Customer without delay of the obstacle due to which the service will not be provided.<\/p>\n

                      \n
                    1. Responsibility for performance of the agreement<\/li>\n<\/ol>\n

                      Maatilamatkailu Kivennapa is responsible to the Customer, on its own behalf and on behalf of its subcontractors, for ensuring that the Customer receives the services in accordance with the agreement as separately stated in each booking and confirmation.<\/p>\n

                        \n
                      1. Liability of the parties and damages<\/li>\n<\/ol>\n

                        The Customer is entitled to compensation only for direct damage caused to them by an error in Maatilamatkailu Kivennapa\u2019s performance, if the error or damage is due to intent or gross negligence by Maatilamatkailu Kivennapa\u2019s entrepreneur, their employee or another trader used as their assistant. The maximum amount of compensation is the amount paid for the Rural Tourism Service, unless there are special grounds for otherwise. <\/p>\n

                        Maatilamatkailu Kivennapa is not liable for damage caused by force majeure or another unforeseeable reason that Maatilamatkailu Kivennapa\u2019s entrepreneur, employee or a trader used as their assistant could not have prevented even by acting with the utmost care. Maatilamatkailu Kivennapa must notify the Customer of the obstacle without delay and seek to act so that the damage suffered by the Customer is kept as small as possible. <\/p>\n

                        The Customer must follow the understandable instructions, warnings and orders given by Maatilamatkailu Kivennava relating to the use of the service, and use the safety equipment specified in the instructions. The Customer is liable for any damage caused intentionally or through negligence by the Customer, a minor under their supervision, the Customer\u2019s guest or an accompanying pet to Maatilamatkailu Kivennava, its business or third parties. <\/p>\n

                        The Customer is responsible for ensuring that they have the valid documents required for using the service, such as a passport, visa, driving licence, firearms licence and proof of payment of the fisheries management fee. The Entrepreneur is not responsible for any voluntary insurance required by the Customer during the trip; the Customer is responsible for their own insurance cover and its scope, for example regarding cancellation cover. <\/p>\n

                          \n
                        1. Remarks and dispute resolution<\/li>\n<\/ol>\n

                          The Customer is obliged to notify the Entrepreneur or their representative immediately upon discovering an error or deficiency of any possible deficiencies that can be corrected during the use of the service. Any other possible remarks that could not have been corrected during the use of the service, as well as any claims for compensation, must be made in writing to the Entrepreneur within a reasonable time after the error was discovered or should have been discovered. <\/p>\n

                          If the Customer and the Entrepreneur cannot reach an agreement, the Customer may submit the dispute to the Consumer Disputes Board for consideration and, ultimately, to be resolved by a court.<\/p>\n<\/div><\/div><\/div><\/div><\/div>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":1,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"100-width.php","meta":{"footnotes":""},"class_list":["post-5571","page","type-page","status-publish","hentry"],"yoast_head":"\nOrder and delivery terms -
